POLICY PROHIBITING DISCRIMINATION & HARRASSMENT

BORUAH FOUNDATION CIC (“BF“) is committed to facilitating an environment at events sponsored by or on behalf of BF (“Events“) that is free of discrimination and harassment. In keeping with this principle, BF has enacted in this Policy Prohibiting Discrimination & Harassment (this “Policy“). BY CLICKING “I AGREE’, ATTENDING A BF EVENT, OR OTHERWISE INDICATING YOUR ACKNOWLEDGEMENT AND AGREEMENT TO THIS POLICY, YOU AGREE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THIS POLICY, YOU AGREE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THIS POLICY. IN ORDER TO ATTEND AN EVENT, YOU MUST AGREE TO THIS POLICY. IF YOU DO NOT AGREE, DO NOT REGISTER FOR OR ATTEND AN EVENT.
Prohibited Conduct
BF strictly prohibits discrimination and harassment of any kind including discrimination and harassment on the basis of race, color, religion, citizenship, political activity or affiliation, marital status, age, national origin, ancestry, physical or mental disability, medical condition (as defined under British law), veteran status, sexual orientation, gender identity, gender expression, sex or gender (which includes harassment and discrimination based on pregnancy, childbirth, breastfeeding, or related medical conditions), or any other characteristics protected under federal, state, or local laws.
Harassment may take many forms, but the most common forms include:
- Verbal harassment – such as jokes, epithets, slurs, negative stereotyping, and unwelcome remarks about an individual’s body, color, physical characteristics, or appearance, questions about a person’s sexual practices, or gossiping about sexual relations;
- Physical harassment – such as impeding or blocking movement, assault, unwelcome physical contact, leering at a person’s body, and threatening, intimidating, or hostile acts that relate to a protected characteristic;
- Visual harassment – such as offensive or obscene photographs, calendars, posters, cards, cartoons, e-mails, drawings, and gestures, display of sexually suggestive or lewd objects, unwelcome notes or letters, and any other written or graphic material that denigrates or shows hostility or aversion toward an individual, because of a protected characteristic, that is placed on walls, bulletin boards, or otherwise circulated.
- Sexual harassment – such as any unwelcome sexual conduct, and includes harassment of women by men, of men by women, and same-sex harassment.
BF prohibits any and all conduct that may reasonably be interpreted as harassment or discrimination whether or not such conduct is pervasive enough or severe enough to meet the technical legal requirements of harassment or discrimination.
Enforcement
You acknowledge and agree that BF reserves the right at any time to disqualify you from participating in, and promptly remove you from, any current or future Event if BF finds that you have violated this Policy. If BF disqualifies you from participating in, or removes you from an Event due to a breach of this Policy, you acknowledge and agree that you will not be entitled to any refund of fees paid relating to such Event.
FURTHER, YOU HEREBY UNCONDITIONALLY AND FOREVER RELEASE, DISCHARGE AND AGREE TO HOLD HARMLESS BF AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, REPRESENTATIVES, AFFILIATES, SUBSIDIARIES, SUCCESSORS AND ASSIGNS, FROM ALL CLAIMS, JUDGEMENTS, COSTS, DAMAGES, LOSSES, EXPENSES AND LIABILITIES BASED ON YOUR BREACH OF THIS POLICY AND YOU HEREBY WAIVE ANY AND ALL DAMAGES YOU MAY HAVE AGAINST BF FOR BF’S TERMINATION OF YOUR ACCESS TO AN EVENT DUE TO YOUR BREACH OF THIS POLICY.
